Abstract

Digital arrest scams are an increasingly sophisticated form of cybercrime, leveraging fear, urgency, and advanced technology to deceive victims. These schemes often involve criminals posing as law enforcement or government officials, using tactics such as fake communications, phishing attacks, and forged documents to manipulate individuals into providing money or confidential information. This study examines the growing prevalence of these scams, focusing on their legal, ethical, and societal dimensions, with a particular emphasis on India alongside global comparisons. Real-life cases, including the ₹5.66 crore Hyderabad scam, are analysed to uncover recurring patterns and weaknesses in the existing legal frameworks. The research evaluates laws such as the Information Technology Act, 2000, and the Bhartiya Nyaya Sanhita (BNS) to identify gaps in enforcement and propose reforms. Additionally, the study explores how scammers exploit psychological vulnerabilities, such as victims’ unfamiliarity with digital systems and legal processes. By adopting a comprehensive approach, this research aims to provide practical solutions, including stronger legal frameworks, improved public awareness, and advanced technological safeguards to mitigate the escalating threat of digital arrest scams.
