Th e present study aims to analyze the evolution of cyber crimes and the diffi culty in identifying those responsible. It seeks to investigate the causes associated with the practice of cyber crimes, such as criminais authorship and the collection of evidence. Demonstrate the vulnerability of Brazilian legislation in the face of criminal practices in the virtual environment, observing the fragility of specifi c norm in the defi nition of some crimes and in the application of sanctions that correspond to the illicit practiced.
